I'm a little late with this post. Okay. A lot late.
Lou Krieger
reports on an arrest of an internet gambling site operatorNo, it doesn't clearly fall under the wire act, Lou. Unless he's taking phyone bets from the US, which I suspect they were.
The AG says internet gambling does fall under the wire act. But the US government also says secterian violence isn't civil war.
The question has gone to two federal appeals courts. One was able to rule on the case without addressing the issue of whether the wire act covers sports betting. The other, the 5th, addressed it directly and found that the wire act does not address it. If found that depositing money and using that money to make a bet are two distinct transactions and that the bet transaction is not taking place in the jurisdiction of the US.
The US government is essentially shopping for a contrary verdict so they can take it to the supremes and get the ruling they want from the nutcases they've put on the court.
But as it stands right now, the law of US is that the wire act does not apply to internet gambling.
